San Diego Regional Analysis of Impediments

The 2020 San Diego Regional Analysis of Impediments to Fair Housing Choice (AI) is the definitive regional assessment of housing discrimination barriers across the county.

Prepared on behalf of SDRAFFH and signed by all 19 participating jurisdictions, the AI identifies impediments to fair housing and recommends actions to address them. It is funded through Community Development Block Grant (CDBG) and local funds contributed by all CDBG entitlement jurisdictions on a pro rata basis.

LEGAL FRAMEWORK

Key Fair Housing Laws

Fair housing in California is governed by both federal and state law. Understanding both is important.

The Fair Housing Act

The federal Fair Housing Act (Title VIII of the Civil Rights Act of 1968) prohibits discrimination in the sale, rental, and financing of housing based on race, color, national origin, religion, sex, familial status, and disability.

California FEHA

California's Fair Employment and Housing Act provides additional protections beyond federal law, adding source of income, marital status, ancestry, sexual orientation, gender identity, gender expression, medical condition, and genetic characteristics. In 2020, SB 329 expanded source-of-income protections to include Section 8 housing assistance.

Unruh Civil Rights Act

California's Unruh Civil Rights Act provides broad protection against discrimination by all business establishments, including housing providers, and applies to all arbitrary discrimination regardless of protected class status.
